Pitfalls of a Do-It-Yourself Divorce

I want to spare you the frustration you will certainly encounter if you attempt a do-it-yourself divorce.

Jefferson County is a large county with a very busy bureaucracy. The officials you deal with may be well-meaning. But they will repeatedly tell you they are "not allowed to give legal advice." Actually, some do not want to be bothered giving any kind of advice, or help, at all.

There may be no areas of disagreement and you may believe you can accomplish an uncontested divorce with a settlement agreement. But there are several issues you are not aware of. This is what lawyers are for. Among potential pitfalls of do-it-yourself divorce, courts frequently leave certain issues unresolved, such as child support and custody issues, or a child's college education. This is called "reserving" an issue that will have to be resolved at a later date.

Paperwork must be completed in exact detail. It must be filed in the right order within the right time periods. It can't be done in one visit. It may be necessary to make several trips to my office, or the county courthouse.

Many couples' attempt at a do-it-yourself divorce is rejected by the court. They often then go to a lawyer and find the expense and trouble is worse than if they had initially spoken to an attorney.

Judges have enough trouble without botched legal cases. They may recognize the earnest attempt and desire to handle a relatively simple divorce by oneself. But aggravating a judge who will make important decisions about your future is never a good idea.
